Cuándo debo resolver mi caso?

Antes que nada, lo más importante es contratar a un especialista certificado en compensación laboral de Pensilvania. Esta es una designación especial, reconocida por la Asociación de Abogados de Pensilvania según lo autorizado por la Corte Suprema de Pensilvania, para abogados que han demostrado dominio de una práctica de compensación laboral de Pensilvania. Ok, una vez que te hayas “abogado”, hay una constelación de factores a considerar. Un factor importante es el apalancamiento. Lo que quiero decir con esto es si hay algún litigio que amenace sus beneficios. ¿Hay una Petición de Terminación, Modificación o Suspensión que está en la corte, que si tiene éxito para el asegurador/empleador, podría reducir o eliminar sus cheques? Si la respuesta es sí, esta es una consideración real para tener en cuenta en la ecuación. Le guste o no, es posible que un juez de compensación laboral no vea las cosas a su manera. Muchos casos involucrarán a médicos que tienen opiniones diferentes, y el juez tiene que elegir un lado sobre el otro. ¿Quién es el juez? ¿Tienden a estar más orientados al reclamante o al empleador en casos de emergencia? ¿Cómo han ido las deposiciones?

Otro factor crítico es si existe la necesidad de un tratamiento médico futuro. ¿Se está contemplando la cirugía? Si el caso se resuelve por una suma global y los beneficios médicos terminan en la fecha de la audiencia, ¿quién pagará? ¿Seguro médico del estado? ¿Seguro privado? Por lo general, si un cliente ha alcanzado el MMI: mejora médica máxima, lo que esencialmente significa que se ha llegado a una meseta, es una mejor situación para considerar resolver un reclamo en lugar de uno en el que se avecinan procedimientos invasivos como inyecciones o cirugía.

Un trabajador lesionado también querrá considerar sus futuras posibilidades vocacionales. ¿Puede el trabajador encontrar un trabajo dentro de sus restricciones poco después de un acuerdo? ¿El monto del acuerdo permitirá que el cliente regrese a la escuela o se capacite para otro tipo de trabajo? ¿Cuál es el plan de juego para volver a ingresar a la fuerza laboral si el cliente no ha estado trabajando? Muchos empleadores, de hecho la mayoría, quieren una renuncia firmada con un acuerdo de suma global (Compromiso y liberación), lo que significa que el empleado acepta no volver a solicitar un puesto con el empleador.

Qué pasa con otros beneficios como el Seguro Social por Incapacidad, Incapacidad a Largo Plazo, Compensación por Desempleo? ¿Cómo afectará estos beneficios la resolución del caso de compensación laboral? Se debe considerar cuidadosamente la coordinación de los beneficios para maximizarlos para un trabajador lesionado. Por ejemplo, con respecto a la Discapacidad del Seguro Social, incorporamos lenguaje en los Acuerdos de Compromiso y Liberación para maximizar el derecho de nuestros clientes a SSD después de que un Juez de compensación laboral apruebe un acuerdo. No puede recibir más del 80% de sus ingresos habituales entre Compensación para trabajadores de Pensilvania y beneficios por discapacidad del Seguro Social.
